It is used to celebrate a person's birthday and comes from a song called Good Morning to All, which was written in English by Mildred J. Hill and Patty Hill in 1893. This version of the song was formally registered in 1935 by Warner/Chappell in the United States, which meant that for decades its commercial use required a license. According to US law, copyrights from that period should expire around 2030, while in Europe protection was based on the death of the author, meaning they would have expired around 2016.
However, in 2015, a US judge ruled that the 1935 rights protected only a specific arrangement of the song, and not the original melody or lyrics. As a result, since then, the song Happy Birthday has been considered in the public domain, allowing it to be sung or used freely, although certain recordings or specific arrangements may still be protected.
